Apie atliekų tvarkymo įstatymą
Seimo Antikorupcijos komisijos prašymu Specialiųjų tyrimų tarnyba (STT) atliko Lietuvos Respublikos atliekų tvarkymo įstatymo 2, 4, 25, 27, 28, 30, 31, 34 ir 35 straipsnių pakeitimo ir papildymo įstatymo projekto Nr. XIP-1036 (toliau – Projektas) antikorupcinį vertinimą.

Nustatyta, kad dėl kai kurių Projekto nuostatų gali kilti komunalinių atliekų tvarkymo sistemos administratorių interesų konfliktų, piktnaudžiavimų ir nebūtų užtikrintas komunalinių atliekų tvarkymo įmonių atrankos skaidrumas.

Priėmus Projekte siūlomas nuostatas, gali būti sudaromos sąlygos nepagrįstam nekilnojamojo turto objektų savininkų įpareigojimui su atliekų tvarkymo įmonėmis sudaryti paslaugų teikimo sutartis, neatsižvelgiant į atliekų turėjimo faktą, savininko galimybes turimas atliekas sunaudoti įstatymu leidžiamais būdais, t. y. žemės ūkyje, energijai gauti ar kitoms reikmėms aplinkai ir žmonių sveikatai saugiu būdu.

STT pareigūnų nuomone, reikia atsižvelgti ne tik į nekilnojamojo turto turėjimo nuosavybės teise faktą, bet ir į faktines atliekų turėjimo aplinkybes, o Projekte numatomų privalomų komunalinių atliekų tvarkymo paslaugų teikimo sutarčių sudarymas turi būti grindžiamas paslaugų teikėjo sąžiningumu: paslaugų kaina ir kokybė turi būti objektyvūs, pagal nekilnojamojo turto objekto savininkų faktiškai atliekų tvarkytojui perduotus atliekų kiekius.
